Terms of Service
Last updated: 17 September 2026
These terms form a contract between you and Atticus Intelligence Ltd, a company registered in England and Wales under number 16130885 ("we", "us"), governing your use of BetterForms (the "Service"). By creating an account you agree to them.
1. Definitions
Customer — the person or organisation holding the account. Respondent — a person who submits answers to a form. Customer Content — forms, questions, settings, branding, prompts, responses collected, and analysis outputs. Plan — the subscription tier you have selected.
2. Accounts
You must be at least 16 and able to form a binding contract. You are responsible for the accuracy of your account details, for keeping credentials secure, and for all activity under your account. Tell us promptly at security@usebetterforms.com if you suspect unauthorised access.
Accounts are for named individuals. Seats may not be shared between people. You may reassign a seat when someone leaves.

Full feature differences are set out on our pricing page, which forms part of these terms.
3.2 Payment
Prices stated in GBP include VAT. Prices stated in USD exclude tax, and applicable sales tax is calculated and added at checkout based on the customer's location. Payment is taken in advance by card through Stripe. Annual plans are charged in a single upfront payment and represent a discount equivalent to two months.
3.3 Seats and changes
Seats added during a billing period are charged pro rata to the end of that period. Seats removed take effect at your next renewal; we do not refund removed seats mid-term. Upgrading between plans takes effect immediately with a pro rata charge. Downgrading, including from annual to monthly billing, takes effect at renewal.
3.4 Renewal and cancellation
Subscriptions renew automatically at the then-current price for the same term unless cancelled before the renewal date. You may cancel at any time from your account settings; cancellation takes effect at the end of the paid period and you keep access until then.
Except where required by law, fees already paid are non-refundable. If you are a consumer in the UK or EEA you have a 14-day right to cancel, which you lose once you ask us to begin providing the Service immediately and we have done so.
3.5 Price changes
We may change prices for new billing periods on at least 30 days' notice. Changes never apply to a term you have already paid for. If you do not accept a change, cancel before it takes effect.
3.6 Non-payment
If a payment fails we will retry and notify you. If it remains unpaid after 14 days we may suspend paid features. We will not delete Customer Content solely for non-payment for at least 30 days after suspension, and we will not close your forms to Respondents during that period.
4. Fair use
Where a Plan describes something as unlimited, that means normal use by humans for the purpose the Service is designed for. It does not cover automated or scripted submission of responses, load or stress testing, deliberate inflation of usage, or sharing one account across an organisation that should hold multiple seats.
If your usage appears to fall outside fair use, we will contact you first and try to agree a solution. Only if that fails will we apply rate limits or restrict features. We will not delete responses, and we will not close your forms to Respondents, as a fair use measure.
5. Your obligations as data controller
For responses collected through your forms, you are the data controller and we are your processor. You are responsible for:
- having a lawful basis to collect the data you ask for;
- giving Respondents the information the law requires, including who you are and why you are collecting it;
- not collecting more data than you need;
- handling Respondents' requests to access, correct, or delete their data; and
- obtaining any consent required where you collect special category data (such as health, ethnicity, religious belief, or sexual orientation) or data from children.
Our Data Processing Agreement at https://usebetterforms.com/dpa governs this relationship and is incorporated into these terms.
Do not enter personal data or confidential information into AI generation prompts.
6. Acceptable use
You must not use the Service to:
- collect data unlawfully, deceptively, or without a valid basis;
- send unsolicited bulk messages, or share form links in ways that breach marketing laws;
- harass, defraud, impersonate, or mislead Respondents;
- upload or collect unlawful, defamatory, or infringing material;
- attempt to gain unauthorised access to the Service or another customer's data;
- probe, scan, or test our systems without written permission;
- resell or white-label the Service without a written agreement;
- circumvent Plan limits, or create multiple free accounts to avoid them.
We may investigate suspected breaches and suspend accounts where there is a serious or ongoing risk.
7. Ownership
You own Customer Content. You grant us a non-exclusive licence to host, copy, transmit, and process it solely to provide the Service, including sending it to the sub-processors listed in our Privacy Policy. This licence ends when you delete the content or close your account, subject to backup retention.
We own the Service, its software, design, and documentation. Nothing here transfers those rights to you. We do not use Customer Content to train AI models.
If you send us feedback or suggestions, we may use them without obligation or payment.
8. AI-generated output
The Service uses automated analysis to generate forms, group open-text answers into themes, and produce summaries. This output is probabilistic. It may miss themes, invent groupings that do not reflect a genuine pattern, misrepresent minority views, or summarise inaccurately.
It is provided as an aid to your own judgement. You should review the underlying responses before relying on the analysis for any decision that matters, and you must not present it as a definitive or complete account of what Respondents said. We make no warranty about its accuracy, completeness, or fitness for any particular purpose.
9. Availability
We aim to keep the Service available but do not guarantee uninterrupted operation. We may carry out maintenance, and will give advance notice of planned downtime where practical. No service level agreement applies to the Free plan.
We may change or discontinue features. If we materially reduce a paid feature, we will give at least 30 days' notice and you may cancel and receive a pro rata refund for the unused portion of a prepaid term.
10. Termination
You may close your account at any time. We may suspend or terminate your account if you materially breach these terms and do not remedy it within 14 days of notice, or immediately where the breach is serious, unlawful, or poses a risk to others.
On termination, your right to use the Service ends. You may export your data for 30 days afterwards, after which it will be deleted in line with our Privacy Policy. Forms will stop accepting responses.
11. Warranties and liability
The Service is provided as described in these terms and our documentation. To the extent permitted by law, we exclude all other warranties, express or implied.
Nothing in these terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or anything else that cannot lawfully be limited. Nothing limits your statutory rights as a consumer.
Subject to that, neither party is liable for loss of profits, revenue, business, goodwill, anticipated savings, or for indirect or consequential loss. Our total aggregate liability arising out of or in connection with these terms is limited to the greater of the fees you paid us in the 12 months before the claim arose, or £100.
You will indemnify us against claims brought by Respondents or third parties arising from your Customer Content or your breach of section 5 or 6.
12. General
Changes. We may amend these terms. Material changes take effect 30 days after we notify you by email or in-product. Continuing to use the Service after that means you accept them. If you do not, cancel before they take effect.
Assignment. You may not assign these terms without our consent. We may assign them to a successor in connection with a merger, acquisition, or sale of assets.
Entire agreement. These terms, the Privacy Policy, the DPA, and the pricing page form the whole agreement between us on this subject.
Severability. If any provision is unenforceable, the rest remains in force.
Third parties. No one other than you and us has rights under these terms.
Governing law. These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer, you may also bring proceedings in your country of residence.
